1. Acceptance of Terms

By accessing or using Affiliate Aura (“the Platform”, “we”, “our”, “us”) at affiliateaura.co, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the updated Terms.

2. Description of Service

Affiliate Aura is an affiliate marketing platform that enables:

• Affiliates to discover products and businesses, generate tracked affiliate links, and earn commissions on referred sales.
• Businesses to list their products, manage affiliate partnerships, set commission rates, and track performance analytics.

3. Account Registration

• You must be at least 16 years old to create an account.
• You must provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not create multiple accounts or share your account with others.
• You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

4. Affiliate Terms

4.1 Link Generation & Tracking

Affiliates may generate unique tracked links for any business listed in the Platform's directory. Commissions are tracked based on verified click-through and sale attribution as recorded by the Platform.

4.2 Commission Payouts

• Commission rates are set by individual businesses and are subject to change with reasonable notice.
• Payouts are processed according to the minimum withdrawal threshold displayed in your dashboard.
• We reserve the right to withhold or reverse commissions attributed to fraudulent activity, self-referrals, or policy violations.
• A tax withholding rate may apply as specified in your dashboard settings and local regulations.

4.3 Prohibited Affiliate Conduct

• Self-referrals — using your own affiliate link to make purchases.
• Incentivised clicks or paid traffic that does not represent genuine customer interest.
• Spamming, misleading advertising, or misrepresenting the businesses you promote.
• Cookie stuffing or any technical manipulation of tracking systems.
• Promoting businesses from jurisdictions or in categories that are prohibited by law in your region.

5. Business Terms

5.1 Listing Your Business

Businesses must provide accurate information about their products, commission rates, and payment terms. Listings that are misleading, contain prohibited products, or violate applicable laws will be removed.

5.2 Subscription Plans

Business accounts are subject to the subscription plan selected at signup. Plan features, link limits, and pricing are as described on our pricing page and are subject to change with 30 days' notice. Payments are processed through Stripe and are non-refundable except as required by law.

5.3 Commission Obligations

Businesses are responsible for honouring the commission rates displayed to affiliates. Any attempt to manipulate tracking data or withhold legitimate commissions is grounds for immediate account termination.

6. Subscription & Billing

• Subscriptions are billed monthly or annually as selected during signup.
• You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period.
• We do not offer pro-rata refunds for partial months unless required by applicable consumer protection law.
• Failure to pay subscription fees may result in downgrade of your account to the free tier.

7. Intellectual Property

The Platform, including its design, code, branding, and content created by Affiliate Aura, is our intellectual property. You may not copy, reproduce, or create derivative works without our written permission.

By submitting content to the Platform (e.g., business logos, descriptions), you grant us a non-exclusive, worldwide, royalty-free licence to display that content on the Platform and in marketing materials promoting your business listing.

8. Prohibited Uses

You agree not to:

• Violate any applicable law or regulation.
• Attempt to gain unauthorised access to any part of the Platform or other users' accounts.
• Use automated tools to scrape, crawl, or excessively query the Platform.
• Upload malicious code, viruses, or any content designed to harm the Platform or its users.
• Harass, abuse, or harm other users.
• Use the Platform to promote illegal products, services, or activities.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion.

You may delete your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately. Pending commission payouts that meet the minimum threshold at the time of termination will still be processed unless the account was terminated for fraud.

10. Disclaimers & Limitation of Liability

The Platform is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or that earnings targets will be achieved.

To the fullest extent permitted by law, Affiliate Aura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or revenue, arising from your use of the Platform.

Our total liability for any claim arising from use of the Platform shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim, or (b) £50 / $50.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
